O Governo Federal publicou nesta quarta-feira (8), no Diário Oficial da União, a resolução do Conselho Nacional dos Direitos da Criança e do Adolescente (Conanda) com orientações para o aborto legal em crianças e adolescentes.
Conforme antecipou a CNN, o Ministério dos Direitos Humanos e Cidadania afirmou que a publicação seria feita “em cumprimento ao regimento do Conanda e à determinação da Justiça”.
A resolução foi aprovada pelo Conselho em 23 de dezembro, mas foi suspensa pela Justiça no dia seguinte após um pedido da senadora Damares Alves (Republicanos-DF).
Na segunda-feira (6), o desembargador Ney Bello, do Tribunal Regional da Primeira Região (TRF-1), suspendeu a decisão que havia derrubado a resolução e autorizou a publicação no Diário Oficial. Ele entendeu que o texto se limita a “cumprir e organizar um direito que já está previsto em lei”.
Ney Bello também afirma em decisão que a resolução tem o potencial de “proteger milhares de meninas, vítimas de violência sexual todos os anos, que sofrem novas violências ao buscar amparo do Estado para proteger seus direitos”.
A norma estabelece diretrizes para orientar o poder público em casos de meninas vítimas de violência sexual que buscam o aborto legal. Ela não muda a lei sobre aborto no Brasil.
Entre as diretrizes, por exemplo, está a prioridade ao desejo da criança ou adolescente em casos de divergência com os responsáveis legais, com suporte da Defensoria Pública ou do Ministério Público.
A aprovação do documento gerou repercussão negativa e discordâncias até mesmo dentro do Conanda. O Conselho é ligado ao Ministério dos Direitos Humanos e composto por representantes do governo e da sociedade civil.
A resolução foi aprovada por 15 votos a favor e 13 contra, todos eles de representantes do governo. Na ocasião, o Ministério lançou uma nota informando que “questionou insistentemente” os termos da resolução e fez um pedido de vista — que suspende a discussão por alguns dias.
Representantes da sociedade civil que integram o Conselho responderam acusando o Ministério de usar “estratégias de atraso” na elaboração da resolução.
