Fim da reeleição e mandatos de 5 anos estão entre as pautas do novo Código Eleitoral

Uma “mini” reforma eleitoral está em pauta no Senado. Parlamentares querem discutir algumas mudanças no Código Eleitoral, como o fim da reeleição, a junção entre as eleições municipais e gerais e a definição de oito anos de inelegibilidade para políticos condenados.

O Novo Código Eleitoral – que consta no projeto de lei complementar 112/2021 – foi aprovado na Câmara há três anos. Ele é de autoria coletiva da própria Casa e uma iniciativa da deputada federal Soraya Santos (PL-RJ).

Ele está em análise no Senado, e o tema é visto como prioridade pelo presidente da Casa, Rodrigo Pacheco (PSD-MG).

De acordo com o senador Marcelo Castro (MDB-PI), vice-líder do MDB no Congresso, o novo Código Eleitoral vai ser analisado no Senado neste mês.

Caso o projeto seja aprovado com mudanças, ele volta para a Câmara para revisão, e depois segue para ser sancionado (ou vetado) pelo presidente da República.

Fim da reeleição

Uma das possibilidades de mudança é o fim da reeleição para os cargos de presidente da República, governadores e prefeitos. Ou seja, políticos não poderiam concorrer novamente ao mesmo cargo. A sugestão, segundo o Senado, vai ser apresentada como propostas de emenda à Constituição por Marcelo Castro.

Contudo, como explica Rubens Beçak, professor de Direito Constitucional e Teoria do Estado da Faculdade de Direito de Ribeirão Preto da Universidade de São Paulo (FDRP-USP), a reeleição ainda é algo recente na história do Brasil.

O docente ainda explica que a prática que consiste na possibilidade de políticos se elegerem novamente ao mesmo cargo surgiu apenas em 1997, durante o fim do primeiro mandato do ex-presidente da República Fernando Henrique Cardoso.

Mandato de 5 anos

O fim da reeleição seria acompanhado por um mandato único de cinco anos e não mais quatro para cargos do Executivo. Ou seja, governadores, prefeitos e o presidente da República.

A alteração também vem de uma PEC que será apresentada por Castro.

Para o professor de Direto Constitucional da Universidade Federal Fluminense (UFF) Gustavo Sampaio Telles Ferreira, o modelo atual faz com que haja uma periodicidade necessária para que haja uma melhor gestão das relações políticas entre a Administração Pública e o Poder Legislativo.

“Um mandato de cinco anos tornaria mais difícil esse entendimento, desajustaria a equação de equilíbrio entre os Poderes ao longo do tempo”, opina o professor.

Já Beçak acredita que, caso realmente a reeleição deixe de existir, o mandato de 5 anos seria necessário.

Sampaio não tem certeza se o Brasil necessita de um novo Código Eleitoral. “Acredito que o tempo que se leva para se adaptar a uma nova realidade legislativa pode promover efeitos mais graves do que manter velhos sistemas em voga”.

Mas, caso siga adiante, as alterações devem ser acompanhadas de transparência.

Inelegibilidade por 8 anos

Outro ponto de destaque é a proposta de uniformizar o tratamento que é dado para os casos de inelegibilidade. O político condenado fica inelegível — ou seja, não pode concorrer em nenhuma eleição e nem assumir um cargo — por oito anos a partir do fim do seu mandato.

Hoje, o condenado fica inelegível já a partir da decisão e depois por oito anos seguintes.

Veja, abaixo, a partir de quando seriam contados os oito anos de inelegibilidade:

  • Senadores, deputados federais, estaduais e vereadores condenados: a partir da data em que é decretada a perda do cargo eletivo;
  • Governadores e vice-governadores, prefeitos e vice-prefeitos: a partir da data em que é decretada a perda do cargo eletivo;
  • Agentes públicos condenados pelo TSE: a partir da data da eleição na qual ocorreu a prática abusiva pelo qual foi punido;
  • Agentes públicos condenados pela Justiça comum: a partir da data em que é decretada a perda do cargo eletivo;
  • Agentes públicos que renunciaram para evitar perda de mandato: a partir da data de renúncia;
  • Agentes públicos condenados por improbidade administrativa: a partir da data da condenação, sendo aplicada inelegibilidade apenas àqueles condenados concomitantemente por lesão ao erário e enriquecimento ilícito.

A minirreforma também prevê uma “quarentena” de quatro anos antes das eleições para que funcionários do Ministério Público, juízes, militares das Forças Armadas, guardas e policiais possam se eleger caso sejam condenados pela Lei da Ficha Limpa.

Coincidência das eleições

A minirreforma também quer coincidir as eleições gerais e municipais. Isso significa que as votações de presidente e vice-presidente da República, governadores, prefeitos, deputados, senadores e vereadores seriam feitas em um mesmo ano.

A medida, contudo, prejudicaria a prática democrática, opina o professor da USP. A periodicidade dos eleitores nas urnas, na visão dele, faz com que haja uma “oxigenação” e mantém a população conectada ao exercício constante da política.

As mudanças valem para 2024?

Não. Caso aprovadas, as mudanças do Novo Código Eleitoral só entrariam em vigor nas eleições gerais de 2026, para a escolha de presidente da República, vice-presidente e deputados.

Segundo a lei, mudanças no sistema eleitoral produzem efeitos apenas nas eleições que se realizarem um ano após o início da sua vigência.
